This document sets forth the terms and conditions for the use of the content and/or services of the websites sistica.com and sistinova.com, of which Sistica or Sistinova is the bailee (comodatario). To make use of the contents and/or services of the website, the user must adhere to the terms and conditions described below:
1. Objective Through the websites sistica.com and sistinova.com, hereinafter referred to as the “website,” SISTICA IT SAS—a Colombian company owner of the sistica.com website and SISTICA, a trade name registered with the Bogotá Chamber of Commerce—provides users with access to various services, links, and content such as information, news, and data of interest to the general community. SISTICA IT SAS may modify the presentation, configuration, and location of the website at any time, as well as the contents, services, and conditions required for its use.
1.1 Scope The purpose of this document is to regulate the access and utilization of content and/or services for the general public on the domains sistica.com and sistinova.com. SISTICA IT SAS reserves the right to make any modification to the website at any time and without prior notice; therefore, the user accepts such modifications. Access to the website by the user is free and open; however, the use of content and/or services entails the fees established by Law for the user. The website only permits access to persons of legal age; therefore, SISTICA IT SAS is not responsible for any breach of this requirement. The website is directed at users residing in Colombia and complies with the legislation established in the country; if the user resides in another country and decides to access the website, they do so under their own responsibility. The administration of the website may be carried out by third parties—that is, persons other than the owner—without affecting these terms and conditions.
1.2 User Rights and Duties User activity on the website, such as posts or comments, shall be subject to these terms and conditions. The user agrees to use the content, products, and/or services lawfully, without violating morals or public order, refraining from any act that affects the rights of third parties or the operation of the website. The user agrees to provide truthful information in the website forms. Access to the website does not imply a relationship between the user and SISTICA IT SAS. The user declares to be of legal age and to have the legal capacity to comply with these terms and conditions.
2. Conditions of Access and Use of the Website The user must make appropriate and lawful use of the website and the content and services offered, in accordance with applicable legislation, the general and specific terms and conditions of use, and other instructions provided on the website. The user must refrain from:
Making unauthorized or fraudulent use of the website, content, or services;
Accessing or attempting to access restricted resources or areas of the website without meeting the conditions required for such access;
Using the website and/or the content and services for illicit or illegal purposes, contrary to the provisions of these general conditions, specific conditions, good faith, and public order, or in a way that is harmful to the rights and interests of third parties, or that may in any way damage, disable, overload, or prevent the normal use of the website;
Introducing or spreading computer viruses on the network or performing actions likely to alter, interrupt, or generate errors or damage to electronic documents, data, or computer systems (hardware and software) of SISTICA IT SAS;
Attempting to access, use, and/or manipulate the databases of SISTICA IT SAS;
Reproducing, copying, distributing, transforming, or modifying the contents, unless authorized by the holder of the corresponding rights or if legally permitted;
Deleting, hiding, or manipulating notes on intellectual property rights and other identifying data of the rights of SISTICA IT SAS or third parties incorporated into the contents, as well as technical protection devices or information mechanisms that may be inserted into the contents and services;
Impersonating another user when using the services offered on the website;
Communicating false or inaccurate data; and, in general, engaging in any conduct that generates any type of damage to the website, SISTICA IT SAS, or third parties.
The user shall be liable for damages of any nature that SISTICA IT SAS may suffer as a result of improper use of the website, in which case SISTICA IT SAS shall exercise pertinent legal actions.
3. Privacy and Personal Data Protection In accordance with Law 1581 of 2012 regarding the Protection of Personal Data, Sistica commits to taking the necessary measures to guarantee user security, preventing the improper use of personal data provided by the user on the website. The use of personal data will be limited to what is provided in this policy, which is available via the “Personal Data Processing Policy” link. The company Sistica or Sistinova reserves the right to modify the personal data processing policy at any time and without prior notice, according to its needs or changes in applicable legislation; the user accepts such modifications. The website involves the use of cookies, which are small amounts of information stored in the browser used by the user, such as login data, user preferences, date and time of access, sites visited, and IP address. This information is anonymous and will only be used to improve the website. Cookies facilitate navigation and make it more user-friendly; however, the user may deactivate them at any time from their browser, understanding that this may affect some functions of the website.
3.1 Public Data Information provided by the user through the website or through physical or electronic forms in compliance with the duty of registration, update, or renewal in public records (mercantile, proponents, non-profit entities, national tourism registry, and other public records handled by SISTICA IT SAS) shall be governed by the principle of publicity inherent to them and by the norms and principles enshrined in the regulations that govern them.
3.2 Purpose of Non-Public Personal Data Users accessing the website are not obliged to provide personal information; therefore, any provision of data is voluntary. Notwithstanding the above, some virtual services available on the website will require the user to fill out a registration form. Personal data provided by the user in any form available on the site will be used to provide the requested service and will be incorporated into a database for which SISTICA IT SAS is responsible. Personal data provided in forms other than public records will be managed confidentially and for the purpose of providing the services and support required by the user, with due constitutional and legal guarantees. SISTICA IT SAS refrains from transferring, selling, or sharing collected personal data without express authorization from the user. Specifically, no mobile information or SMS consent will be shared with third parties or affiliates for marketing or promotional purposes. Likewise, SISTICA IT SAS will update, rectify, or delete data when it proves inaccurate, incomplete, or no longer necessary or relevant for the initial purpose.
3.3 Data Quality When filling out the forms on the website, no user may use the identity or data of another person. At all times, the user must ensure they only include data corresponding to their own identity, which must be adequate, relevant, current, and true. The user shall be solely responsible for any damage caused to third parties or SISTICA IT SAS by using another person’s personal data or by including erroneous, false, outdated, inadequate, or impertinent information regarding their own data. SISTICA IT SAS may confirm the provided personal data by approaching public entities, specialized companies, or credit bureaus to verify its veracity. Information obtained by SISTICA IT SAS from these entities will be treated confidentially.
3.4 Exercise of Habeas Data Rights The user may exercise their right to know, update, rectify, and delete personal data provided to SISTICA IT SAS by sending a communication to the email protecciondedatos@sistica.com, indicating the request or right exercised, the user’s full name, and contact details for notifications. This right may be exercised, among others, against partial, inaccurate, incomplete, or misleading data, or data whose processing is expressly prohibited or has not been authorized by the holder. In the case of data forming part of public records, the holder must request an update via a private document, presented in person or with a certificate of personal appearance before a Notary, at SISTICA IT SAS, and pay the established fee for that purpose.
3.5 Cookies SISTICA IT SAS uses cookies during the provision of website services. Cookies are physical files of personal information stored on the user’s terminal. If the user leaves the website via links to other sites, SISTICA IT SAS is not responsible for their privacy policies or the cookies they may store on the user’s computer.
3.6 Security Measures Adopted Regarding Data Processing SISTICA IT SAS informs the user that it has adopted the necessary technical, legal, and administrative measures to guarantee the security of personal data and prevent its alteration, loss, or unauthorized processing or access.
3.7 Sending of Commercial, Promotional, or Service Information Prior to data collection, users’ express consent will be requested so that SISTICA IT SAS may use the data to send information or advertising via email or text messages to mobile phones. If the user later wishes to revoke the consent granted to receive commercial information, they may communicate this by sending a message to the email protecciondedatos@sistica.com.
3.8 Privacy Policy, Manual, and Notice Without prejudice to the provisions contained in these terms, SISTICA IT SAS has established its privacy policy, manual, and notice regarding the processing of all personal databases for which it is responsible, which can be consulted on the website’s home page under the “Policies” option in the footer menu.
4. Intellectual Property Rights Intellectual property rights over the contents or any element inserted into the website (including, without limitation, trademarks, logos, trade names, texts, images, photographs, graphics, designs, sounds, databases, software, audio, and video) belong to SISTICA IT SAS and/or third parties. All content on this website is protected by Colombian and international copyright laws. In no case does access to the website imply any type of waiver, transmission, license, or total or partial assignment of such rights, unless expressly stated otherwise. These general conditions of use do not confer upon users rights to use, alter, exploit, reproduce, distribute, or publicly communicate the website or its contents other than those expressly provided for. Any use or exploitation of such rights shall be subject to prior and express authorization granted for that purpose by SISTICA IT SAS or the third-party owner of the rights. SISTINOVA is a trade name describing a subsidiary company of SISTICA IT SAS operating in the technology sector, initially in Colombia and in the future worldwide. Trademarks owned by SISTICA IT SAS may not be used or displayed publicly without prior written consent from the owner, except for logos and photographs downloaded as set forth elsewhere on this website. All rights not expressly granted herein are reserved.
5. Introduction of Links 5.1 Link Policies The website may contain links to other internet sites belonging to third parties for which Sistica or Sistinova is not responsible. Any user wishing to establish a hyperlink or link between their website and the SISTICA IT SAS website must comply with the following conditions: a) the link will only allow access to the homepage of the website but may not reproduce it in any way; b) no false, inaccurate, or incorrect statements shall be made about the SISTICA IT SAS website; c) it shall not be stated or implied that SISTICA IT SAS has supervised or assumed in any way the contents or services offered or advertised on the linking website; d) the linking website shall not contain any trademark, trade name, logo, slogan, or other distinctive signs belonging to SISTICA IT SAS without its authorization; e) the linking website shall not contain information or content that is illegal, contrary to morals and generally accepted good customs and public order, or contrary to the rights of third parties. The establishment of the link does not imply the existence of any relationship between SISTICA IT SAS and the owner/operator of the linking website, nor the knowledge, acceptance, and/or approval by SISTICA IT SAS of its contents and/or services. 6. Exclusion of Warranties and Liability 6.1 Exclusion of Warranties and Liability for Website Operation SISTICA IT SAS shall not be responsible for damages derived from: a) failures in website operation due to causes beyond the control and diligence of SISTICA IT SAS; b) interruption in website operation or computer failures, disconnections, delays, or blocks caused by deficiencies or overloads in the networks, the Internet system, or other electronic systems; c) the lack of suitability of the website for specific user needs; and d) damage caused by third parties through unauthorized interference beyond the control of SISTICA IT SAS. SISTICA IT SAS does not guarantee the absence of viruses or other elements on the website introduced by third parties that may produce alterations in the computer systems (software and hardware) of users. Consequently, SISTICA IT SAS shall in no case be responsible for damages derived from the presence of viruses or other elements that may produce alterations in the physical or logical systems, electronic documents, or files of users.
6.2 Exclusion of Warranties and Liability Regarding Links The website provides users with links allowing them to access third-party pages or websites. In no case is SISTICA IT SAS responsible for, nor does it approve or endorse the products, services, contents, information, data, files, and any kind of material existing on such web pages. If deemed appropriate or if required by judicial or administrative order, SISTICA IT SAS will remove links to web pages that infringe applicable legislation or harm the rights of third parties.
7. Content and Publications Economic data and indicators included in the website are purely informative and have been taken from reliable sources; however, it is the user’s responsibility to verify their validity and currency with the entities that directly report them. Legal information provided through the website does not replace the legal publication of laws or regulations that must be formally published in official diaries, gazettes, or bulletins.
8. Making Payments For the payment of products or services offered by SISTICA IT SAS on the website, the user may access and use the web pages of third parties with which SISTICA IT SAS has agreements for internet payments. Once on the third-party website, the user must follow the instructions and comply with the terms and conditions of that site.
9. Integrity and Severability If any provision of these terms is found to be ineffective, null, non-existent, or unenforceable under the laws of the Republic of Colombia, the remaining provisions shall not be invalidated unless the contract cannot be executed without the ineffective or unenforceable provision.
10. Applicable Law and Jurisdiction The relationship between the user and Sistica regarding the use of the website is governed by Colombian law. Sistica is not responsible for the improper use of the content, products, and/or services of the website and the breach of these terms and conditions. The general and specific terms of use are governed by and must be interpreted in accordance with the laws of the Republic of Colombia. For all legal purposes arising from the development and fulfillment of obligations derived from them, the city of Bogotá – CUNDINAMARCA, Colombia, is designated as the contractual domicile. Intellectual Property SISTICA IT SAS is the holder of all rights over the software of this website, as well as industrial and intellectual property rights referring to the content included therein. It also reserves all copyrights, including those not mentioned in this document. The intellectual property over the website contents (texts, graphics, logos, animations, sounds, and databases, among others) either belongs to SISTICA IT SAS or is owned by third parties who authorized their use on the website, or is public information governed by Colombian public information access laws. The texts and graphic elements constituting the website, as well as their presentation and assembly, are the exclusive property of SISTICA IT SAS, which holds the necessary exploitation rights. Some materials on this website may be protected by copyright when mentioned in the content. Therefore, any unauthorized use, as well as breach of the terms, conditions, or notices contained therein, may violate current national regulations.
