The User agrees that by purchasing or downloading the Digital Products, they are bound to comply with all the provisions of these Terms and Conditions. Sistica may modify these Terms at any time by publishing the updated version on the Site. Continued use of the Digital Products after the publication of such changes constitutes acceptance of them.
Sistica grants the User a limited, non-exclusive, non-transferable, and revocable license to access and use the Digital Products solely for personal or professional purposes, in accordance with these Terms and Conditions. Unless otherwise stated, the license does not grant the right to sublicense, sell, resell, lease, assign, or transfer the Digital Products to any third party.
Use Restrictions
The User may not copy, reproduce, distribute, modify, create derivative works, decompile, reverse engineer, or extract the source code of the Digital Products unless expressly permitted by applicable law. The use of Digital Products for illegal, defamatory, fraudulent purposes or in any way that infringes the rights of third parties, morality, or public order is prohibited.
Digital Products are available for purchase through the Site. The offering may vary depending on geographical region and other factors.
Pricing and Currency
All prices will be displayed in the currency indicated on the Site and may be subject to additional taxes and fees depending on the User’s location. Prices may change at any time without prior notice.
Payment Methods
Sistica offers various payment methods, which will be available at the time of purchase (credit/debit cards, payment gateways, etc.). The User guarantees that the payment information provided is truthful, accurate, and up-to-date.
Purchase Confirmation
Upon payment confirmation, the User will receive an email from Sistica with the necessary information to download or access the Digital Product.
Due to the intangible nature of Digital Products, sales are considered final, and refunds will not be granted once the purchase is made, unless required by applicable law or deemed appropriate by Sistica under special circumstances.
Exceptions
In exceptional cases (e.g., total inability to access the Digital Product due to failures attributable to Sistica), the User may contact customer service to explain their situation. Sistica will evaluate each case and make a determination at its sole discretion.
All intellectual property rights associated with the Digital Products (trademarks, logos, source code, design, graphics, texts, etc.) belong to Sistica or its licensors.
Authorized Use
Any use of the Digital Products not contemplated in these Terms and Conditions must be previously authorized in writing by Sistica. The User agrees to respect the copyrights and intellectual property rights of Sistica and third parties.
Digital Products are provided “as is” and “as available,” without any kind of warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Sistica does not guarantee that Digital Products are error-free, vulnerability-free, or interruption-free, nor that they meet the User’s specific requirements.
User Responsibility
The User acknowledges and agrees that the use of Digital Products is at their sole and exclusive responsibility. Sistica assumes no liability for damages or losses that may result from the installation, use, or inability to use Digital Products.
To the maximum extent permitted by applicable law, Sistica, its directors, employees, affiliates, agents, and suppliers shall not be liable to the User or any third party for any direct, indirect, incidental, special, or consequential damages (including but not limited to damages for loss of data, profits, business interruption, or other economic damages) arising from the use or inability to use the Digital Products, even if advised of the possibility of such damages.
Third-Party Content
Sistica assumes no liability for content, tools, or services provided by third parties that may be linked or integrated with Digital Products.
Force Majeure
Sistica will not be liable for non-compliance or delays caused by events of force majeure or unforeseeable circumstances (such as natural disasters, telecommunications failures, armed conflicts, governmental restrictions, etc.).
The User agrees to provide truthful and accurate information in all registration, purchase, or subscription forms necessary to access Digital Products.
Proper Use
The User is obligated to use Digital Products responsibly, complying with applicable laws and avoiding any conduct that may harm Sistica or third parties.
Confidentiality
If the User receives confidential information related to Digital Products, they agree not to disclose it to third parties without prior authorization from Sistica.
Sistica may terminate this agreement in the event of the User’s breach of these Terms and Conditions without prior notice or any right to a refund.
Effects of Termination
In the event of termination, the license to use the Digital Products will be immediately revoked, and the User must cease all use of them.
These Terms and Conditions shall be governed and interpreted in accordance with the laws of the country or state where Sistica is domiciled or, alternatively, as determined by Sistica without regard to its conflict of law principles.
Dispute Resolution
Any dispute or claim arising out of or related to these Terms and Conditions, which cannot be resolved amicably, shall be submitted to the competent jurisdiction as defined by applicable law or expressly indicated by Sistica.
If any provision of these Terms and Conditions is declared null or unenforceable by a competent authority, such provision will be considered separable from the rest, which will remain valid and enforceable.
